Condizioni generali di accesso e di utilizzo delle risorse elettroniche
Le condizioni di utilizzo delle risorse elettroniche sono stabilite dalle licenze d'uso sottoscritte fra l'Ateneo e gli editori o produttori di periodici elettronici, banche dati e libri elettronici.
L'utente è tenuto a rispettare le Licenze d'uso relative alle risorse consultate; l'inosservanza di tali termini può causare l'interruzione dell'accesso alle risorse per l'intero Ateneo e l'applicazione di eventuali sanzioni.
Pur nella diversità di tali licenze si possono individuare alcune caratteristiche comuni che è opportuno tenere presenti e che si elencano di seguito.
Utenti autorizzati
- studenti, laureandi, dottorandi, borsisti
- personale docente, anche a contratto (per la durata del rapporto)
- personale tecnico-amministrativo anche a tempo determinato (per la durata del rapporto)
- altri utenti ammessi anche temporaneamente all'utilizzo dei servizi all'interno delle singole biblioteche (walk in users, visiting professors).
Modalità di accesso
- tramite i computer collegati alla rete dell'Ateneo
- mediante il Servizio di accesso da remoto le cui istruzioni sono disponibili all'indirizzo https://sba.unisalento.it/accessoremoto, ad esclusione degli utenti di cui al punto 4.
Usi consentiti
E' consentito visualizzare, scaricare, stampare singoli articoli, singoli capitoli o altre singole parti per uso personale di studio, didattico o di ricerca con obbligo di citazione.
Usi NON consentiti
- fare un utilizzo commerciale del materiale oggetto della licenza vendendolo, noleggiandolo, prestandolo dietro compenso a terzi senza un preventivo consenso da parte dell’editore
- rimuovere, alterare o modificare il nome dell’autore, le notizie di copyright o ogni informazione identificativa che appaia sul materiale oggetto della licenza o creare opere derivate senza il consenso da parte dell'editore
- salvare, stampare o copiare in modo sistematico il materiale
- salvare, stampare o copiare ingenti quantità di dati, anche attraverso software specifici
- consentire a utenti non autorizzati l’accesso alle risorse oggetto della licenza, anche diffondendo o rendendo pubblici username e password di accesso riservati.
Document Delivery
Generalmente non è consentito il document delivery elettronico dei pdf/HTML nativi, ma solo l'invio del documento stampato.
Il document delivery elettronico dei pdf/html nativi e/o l'utilizzo di Nilde per l'invio degli articoli o capitoli di libri è previsto solo in alcune licenze d'uso. Sarà cura del personale bibliotecario verificarne la possibilità consultando l'archivio delle clausole per il DD di Nilde.
Dispense elettroniche
Alcuni editori consentono di includere parte del materiale oggetto della licenza d'uso (articoli o parti di riviste, capitoli o parti di libri, immagini, tabelle etc.) in dispense elettroniche o altro materiale per scopi didattici, fermo restando l'obbligo di citazione della fonte.

“Authorized Users” means, those serving in the capacity of employees, faculty and other teaching staff, and person officially registered as full or part-time students located at an Authorized Site. Authorized Users may access the ACS Products from remote sites. Others who are physically present at an Authorized Site may access the ACS Products but may not do so from locations outside of an Authorized Site ("Other Users")PERMITTED USES
Authorized Users and Other Users may view, download, save, or print individual articles, individual book chapters, proceedings, Reagent Chemicals monographs or other individual items from the ACS Products for their personal scholarly, research and educational use.OMISSIS
Authorized Users and Other Users may make a printed copy of individual articles, individual book chapters, proceedings, Reagent Chemicals monographs or other individual items from the ACS Products for the internal or personal use of others who are Authorized Users but who are unable to access the ACS Products, Authorized Users and Other Users may include (and are encouraged to provide) links as well as part of the Licensed Materials with appropriate attribution to ACS content to the ACS Products as part of course pack offerings or within an e-mail communications. Except as set forth in Prohibited Uses herein, Participating Consortium members may use the ACS Products to fulfill request for Interlibrary Loans ("ILL"). ILLs are permitted to support non-commercial scholarly research by patrons of other libraries such as public, school, or college libraries. Participating Consortium Members may obtain a copy of an individual article, individual book chapters, proceedings, Reagent Chemicals monographs or other individual items from the ACS Products in pdf format (Portable Document Format) and transmit it to the ILL requesting Library by mail, fax, or electronic transmission.OMISSIS
PROHIBITED USES
Except as provided in Permitted Uses herein, Participating Consortium Members, its Authorized Users and Other Users agree not to forward, transfer, sell, rent, or otherwise knowingly distribute or provide access to the ACS Products or any portion thereof, to any third party. Individual articles, individual book chapters, proceedings, Reagent Chemicals monographs or other individual items from the ACS Products and other information obtained under this Agreement may not be used for fee-for-service purposes such as document delivery, excepted under a separately negotiated transactional agreement. The ACS Products may not be used to supply single articles, individual book chapters, proceedings, Reagent Chemicals monographs or other individual items to ILL requester that are employed by a commercial organization or by a library that belongs to a for-profit company without prior written approval of ACS. Authorized Users and Other Users may not modify, alter or create derivative works of the materials contained in the ACS Products without prior written permission from ACS. Indexing, by human or machine means, aggregating, data mining, peer-to-peer (or similar) file-sharing are all prohibited uses unless an institution concludes a specific, separate agreement with ACS to do so. Authorized Users and Other Users may not use illustration or other graphic excerpts or abstracts without a complete citation and the inclusion of a persistent URL link to the appropriate material within ACS Products. Individual articles, book chapters, Reagent Chemicals monographs, and other individual items from the ACS Products that include information obtained as a result of access to the ACS Products are not to be systematically downloaded, re-published in any media, print or electronic form. 4. PROPRIETA’ INTELLETTUALE
4.1 Il Sottoscrittore riconosce che ogni diritto, titolo e/o interesse sul, e/o connesso al, Prodotto, ivi compresi, senza limitazione alcuna, i Diritti di proprietà intellettuale, sono e saranno di proprietà o disponibilità di BvD e/o, se del caso, dei suoi licenzianti. Il Sottoscrittore riconosce di poter utilizzare il Prodotto solo ed esclusivamente a fronte di espressa autorizzazione da parte di BvD.
4.2 In virtù dell’Abbonamento, il Sottoscrittore non acquisisce sul Prodotto alcun diritto, esplicito o implicito, diverso da quanto espressamente stabilito nelle Condizioni Generali e nell’Abbonamento.
4.3 Il Sottoscrittore non è autorizzato a decodificare, disassemblare, decifrare, tradurre o modificare il Prodotto, né a creare derivati dello stesso, né a tentare di reperire il codice sorgente del Prodotto o parte di esso, senza previa specifica autorizzazione scritta dal BvD.
5. CONDIZIONI D’USO – USO CONSENTITO
5.1 Il Sottoscrittore può utilizzare e servirsi del Prodotto esclusivamente per finalità di Didattica e di Ricerca e non può consentire a terzi (che non rientrano negli utenti istituzionali dell’Istituzione) di utilizzare il Prodotto senza previo consenso scritto di BvD.
5.2 Il Sottoscrittore è consapevole che il Prodotto non può essere dallo stesso fornito, venduto, affittato, concesso in sub licenza, in leasing, scaricato, ceduto, copiato o riprodotto, diffuso, distribuito, o altrimenti sfruttato a scopo di lucro, fatto salvo quanto previsto nelle Condizioni Generali e nell’Abbonamento. Qualora, per qualsivoglia motivo, si rendesse necessario per il Sottoscrittore eseguire una copia del Prodotto, il Sottoscrittore dovrà ottenere obbligatoriamente il preventivo consenso scritto da parte di BvD.
5.3 Le informazioni acquisite tramite l’accesso alle banche dati BvD non possono essere ridistribuite a terzi non afferenti all’ente di riferimento (Istituzione intestataria dell'Abbonamento) a nessun titolo, gratuito ovvero oneroso. L’utilizzatore è tenuto a non utilizzare robot o qualunque altro sistema automatico per accedere alle Banche dati BvD in modo da ottenere informazioni dai database. L’utilizzatore è altresi tenuto a non effettuare il download sistematico dei dati contenuti nei database BvD o di significativi segmenti degli stessi.
5.4 Il Sottoscrittore dovrà fare in modo che nessuno dei suoi dipendenti e/o consulenti (tantomeno alcuno dei dipendenti e/o consulenti di società affiliate), possa utilizzare il Prodotto e accedere ai dati e/o alle informazioni in esso contenute per creare un prodotto alternativo, che, viepiù: (a) sia in concorrenza con il Prodotto; (b) fornisca medesimi e/o analoghi contenuti e funzionalità del Prodotto.
5.5 Il Prodotto potrà essere utilizzato dal Sottoscrittore all’interno della sua organizzazione secondo quanto stabilito nel Contratto di Abbonamento.

AUTHORIZED USERS
AIP grants to the Subscriber and Authorized Users at participating institutions online access to subscribed titles. This grant extends only to the Subscriber and to Authorized Users at participating institutions and may not be transferred or extended to others. “Authorized Users” means only the employees, faculty and students officially affiliated with the Subscriber, and persons with legal access to the Subscriber’ library collections and facilities on-site, using an IP address within the ranges identified in Appendix C, or off-site via Secure Authentication and who are affiliated with the participating institutions (whether on a permanent or temporary basis). Persons who are not a current member of the Subscriber, but who are permitted to access the Subscriber information services from computer terminals within the physical premises of the participating institutions, 'Walk-In Users', are also deemed to be Authorized Users, only for the time they are within these physical premises. “Walk-In Users” may not be given means to access the Licensed Material when they are not within these physical premises.
PERMITTED USE
a. Authorized Users are permitted online access to the Licensed Material listed in Appendix A, and may download, save, or print text, search results, or other information solely for their private use or research. The Subscriber and Authorized Users may only use this online access in a way that conforms with all applicable laws and regulations.
b. The Publisher of each online journal listed in Appendix A grants the Subscriber and Authorized Users permission to use brief quotations from the content of the online journals with the customary acknowledgment of the source, and to copy and transmit content from individual articles in “person-to person” and non-systematic scholarly exchanges of information between Authorized Users and specific individuals.
c. Subscriber may supply a copy of an article to a library that is not a participating Institution only under the following conditions:
1. Only a hard copy printed from the electronic files of the Licensed Material may be supplied to another library, by mail, fax, or Ariel. Under no circumstance may an AIP-prepared electronic article file be transmitted in digital form by a Subscriber library to a non-participating library or to any other person or institution.
2. Subscriber may not supply an article to another library on a commercial, revenuegenerating basis without full payment of the Publisher’sroyalty, as indicated by the Item Fee Code for each publication.
3. No article may be supplied to a corporation or other non-academic institution without full payment of the Publisher’s royalty.
4. Subscriber may not remove, obscure or modify copyright notices that are part of an article to be printed and supplied to another library.
5. Only article requests from non-participating academic libraries within Italy may be fulfilled, under the conditions indicated above.
d. Faculty at participating institutions may include articles from the Licensed Material in anthologies (coursepacks) in print or digital form for distribution to Authorized Users for their use in connection with classroom instruction or in reserves (print or digital) set up by Subscriber libraries for access by Authorized Users in connection with specific courses offered by the Subscriber. Copies of items in digital form which are included in online coursepacks or reserves will be deleted by the Subscriber after the end of the semester in which the related course concludes.
PROHIBITIONS ON CERTAIN USE
a. Licensee shall not knowingly permit anyone other than Authorized Users to use the LicensedMaterials. Altering, recompiling, reselling, publishing or republishing of any journal text, search result, or other information from the Licensed Materials, or any portion thereof, in any form or medium, is prohibited.
b. Systematic or programmatic downloading, printing, transmitting, or copying of the Licensed Material is prohibited. “Systematic or Programmatic” means downloading, printing, transmitting, or copying activity of which the intent or the effect is to capture, reproduce, or transfer the entire output of a journal volume, a journal issue, or a journal topical section, or sequential or cumulative search results, or collections of abstracts, articles, or tables of contents. Other such systematic or programmatic use of the Licensed Material that interferes with the access of Authorized Users or that may affect the performance of the Publishers’ systems, for example, the use of “robots” to index content, or downloading or attempting to download large amounts of material in a short period of time, is prohibited. Redistribution of the Licensed Material, exceptas permitted in Section 5, without permission of the Publishers and/or payment of a royalty to the Publishers or to the appropriate Reproduction Rights Organization, is prohibited.
c. All rights not expressly granted herein are reserved to the stated Publisher of the Licensed Material. The Subscriber and Authorized Users may not circumvent AIP’s access control systems or the Publishers’ systems or services to make any attempt to gain unauthorized access to any other system or network

Condizioni di utilizzo
1. AUTHORIZED USERS
The Publisher grants the Licensee and its Authorized Users online access to the Licensed Materials. This grant extends only to the Licensee and its Authorized Users and may not be transferred or extended to others. For purposes of this Agreement, an “Authorized User” is any individual who is an employee, faculty staff, or student officially affiliated with the Licensee and persons with legal access to the Licensee’s collections and facilities on site. Authorized Users may be persons remote from the Licensee’s physical location whose access is administered from the Licensee’s site or campus. This Agreement extends only to the Licensee and such Authorized Users and may not be transferred or extended.
3. PERMITTED USE
a. The Authorized Users are permitted online access to the Licensed Materials, and may download, save, or print text, search results, or other information from the Licensed Materials solely for their private use or research and may only use this online access in a way that conforms with all applicable laws and regulations.
b. The Licensee may include articles from the Licensed Materials in coursepacks in print or digital form for distribution to Authorized Users for their use in connection with classroom instruction or in reserves (print or digital), which are to be deleted by the Licensee after the end of the semester in which the related course concludes.
c. The Publisher grants the Licensee and Authorized Users permission to use brief quotations from the content of the online Licensed Materials with the customary acknowledgment of the source, and to copy and transmit content from individual articles in “person-to-person” and non-systematic scholarly exchanges of information between Authorized Users and specific individuals.
d. Interlibrary Loan: Individual articles contained in the Licensed Materials may be supplied to another library, provided the electronic file is deleted immediately after printing, for the purpose of research or private study and not for commercial use.
e. The Licensee agrees that use of the Licensed Materials by Authorized Users other than indicated above is a violation of the terms of this Agreement. Any other use of the Licensed Materials requires the written permission of the copyright holder.
5. PROHIBITIONS ON CERTAIN USE
a. The Licensee shall not knowingly permit anyone other than Authorized Users to use the Licensed Materials. Altering, recompiling, systematic or programmatic copying, reselling, redistributing, publishing or republishing (beyond the uses permitted under Section 3) of any journal text, output, search result, or other information from the Licensed Materials, or any portion thereof, including without limitation, copyright, proprietary and/or other legal notices contained therein, in any form or medium is prohibited.
b. Systematic or programmatic downloading of the Licensed Materials (for example, downloading entire journal issues), service bureau redistribution services, printing for fee-for-service purposes and/or the systematic making of print or electronic copies of individual titles for transmission to persons other than Authorized Users are prohibited. Downloading portions of the Licensed Materials for the purpose of creating systematic and persistent local copies (not including transient, dynamic caches of individually requested material) for redistribution is prohibited.
c. All rights not expressly granted herein are reserved to the stated Publisher of the Licensed Materials. The Authorized Users may not circumvent the Publisher access control systems or use Publisher systems or services to make an attempt to gain unauthorized access to any other system or network.
d. Authorized Users shall not redistribute the Licensed Materials or any article therein to a country to which export is prohibited by U.S. law or regulation.
